TUCSON, Ariz. (AP) – A man accused of robbing marijuana smugglers after they sneak into the United States is scheduled to be sentenced on a conspiracy charge on Sept. 10.
Authorities say Rito Osorio-Arellanes was part of a ring that preyed on smugglers.
Five other members of the alleged rip-off crew are also charged with murder in the December 2010 shooting death of U.S. Border Patrol Agent Brian Terry.
Rito Osorio-Arellanes was in custody before the shootout and doesn’t face murder charges.
He pleaded guilty in February to a charge of conspiracy to interfere with commerce by robbery.
Two guns found at the shooting scene were bought by a member of a separate gun smuggling ring that was being monitored in the federal government’s botched gun smuggling probe known as Operation Fast and Furious.
